Military Duty Leave for Employees in Minnesota

Private sector employees in Minnesota who engage in active service in the military forces in time of emergency are entitled to leave without pay and reinstatement rights. The leave may not extend beyond the time the individual is required to serve.

Reinstatement. A person who engages in active service in the military forces in time of emergency is entitled to leave and reinstatement without loss of seniority, efficiency rating, vacation, sick leave, or other benefits. Such leave need not be paid.

Discrimination. Discharging any person from employment because of membership in the U.S. or state military or naval forces, hindering any person from performing military service, or to dissuading any person from enlistment in the military service by threat or injury is prohibited.
