Military Duty Leave for Employees in Kentucky

An employee in Kentucky must be granted a leave of absence for the period required to perform active duty or training in the national guard. However, no employer is required to grant an employee a leave of absence with pay.

Reinstatement. Upon the employee's release from active duty or training, the employee must be permitted to return to his or her former position of employment with the seniority, status, pay, and any other rights or benefits the employee would have had if not absent.

Discrimination. No person may willfully deprive a member of the National Guard of his employment or prevent the person's employment because of membership in the National Guard.
